Welcome to TeachKit, a platform owned and operated by Makeable Brand LLC, located in Boise, Idaho. These Terms and Conditions govern your use of the TeachKit platform, including the creation and enrollment in free online courses. By creating an account or using the platform, you agree to these terms. If you do not agree, please do not use the platform.

1. Platform Overview

TeachKit is a free online course platform that allows users to create an account which serves as both a teacher and a student account. Teachers can create free courses, embed videos, provide instructions/assignments, and optionally tag enrollees in their Kit accounts.

2. Account Registration

• You must create a free account to use TeachKit.
• Users must provide accurate and complete information during registration.
• Each account serves as both a teacher and student account.

3. User Responsibilities

• Teachers: You are responsible for the content of the courses you create, including any embedded videos, instructions, or assignments. You must ensure that all content complies with these terms and applicable laws.
• Students: You are responsible for adhering to course requirements and respecting the intellectual property of the course creators.
• All Users: You may not use TeachKit for any illegal, harmful, or unauthorized purposes.

4. Content Guidelines

• All content must comply with applicable copyright, intellectual property, and privacy laws.
• Teachers must ensure that any embedded videos or materials are either their own or properly licensed.
• Prohibited content includes but is not limited to:
• Hateful, defamatory, or discriminatory content
• Pornographic or sexually explicit materials
• Content promoting illegal activities

5. Data Usage

• TeachKit collects user data to operate the platform. By creating an account, you consent to the collection and use of your data as outlined in our Privacy Policy.
• Teachers can optionally tag students enrolled in their courses in their Kit accounts. By enrolling in a course, you agree to this tagging feature.

6. YouTube API Services

• TeachKit may allow you to connect your YouTube account to automatically list and embed your videos in courses.
• This integration uses Google's OAuth 2.0 flow and requests the `https://www.googleapis.com/auth/youtube.readonly` scope.
• Access is read-only and is used solely to retrieve video information; TeachKit does not modify or delete any YouTube content.
• By using this feature you agree to the YouTube Terms of Service and Google Privacy Policy.
• You can revoke TeachKit's access at any time in your Google account settings.

7. Intellectual Property

• Users retain ownership of the content they create and upload to TeachKit. By uploading content, you grant TeachKit a non-exclusive license to display and distribute the content as part of the platform’s operations.
• You are prohibited from copying, redistributing, or using another user's content without permission.

8. Liability and Disclaimers

• TeachKit is provided “as-is” and “as-available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Exclusion of Damages: To the fullest extent permitted by applicable law, Makeable Brand LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of profits, loss of goodwill, service interruption, or unauthorized access — arising out of or in connection with your use of TeachKit, even if Makeable Brand LLC has been advised of the possibility of such damages.
• Limitation of Liability: To the fullest extent permitted by applicable law, Makeable Brand LLC's total cumulative liability to you for any claims arising out of or related to these Terms or your use of TeachKit shall not exceed zero dollars ($0.00), reflecting that TeachKit is provided entirely free of charge.
• Users are solely responsible for the content they create, share, or access on TeachKit.

9. Indemnification

You agree to defend, indemnify, and hold harmless Makeable Brand LLC and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to TeachKit; (b) your violation of these Terms; (c) any content you create, upload, or distribute through the platform; or (d) your violation of any third-party right, including any intellectual property, privacy, or property right.

10. Refund Policy

TeachKit Refunds (for Teachers):

If you purchase a paid plan on TeachKit and are not satisfied, you may request a full refund within 30 days of your original purchase date. Refund requests must be submitted in writing via our support contact form or email. After 30 days, all payments are considered final and non-refundable. This policy applies only to subscription fees paid directly to TeachKit.

Student Purchases (via Teachers):

All student purchases are processed through each teacher’s connected Stripe account. Because teachers are the direct sellers of their courses, they are solely responsible for setting and managing their own refund policies for students. TeachKit does not handle or mediate student refunds. Any refund requests from students must be directed to the individual teacher who sold the course.

11. Termination

• Makeable Brand LLC reserves the right to suspend or terminate any account or course at its discretion, particularly for violations of these terms.
• Users may delete their accounts at any time by request.

12. Changes to Terms

• Makeable Brand LLC reserves the right to update these terms at any time. Notice of changes will be posted on the platform. Continued use of TeachKit after changes constitutes acceptance of the updated terms.

13. Governing Law

These Terms and Conditions are governed by the laws of the State of Idaho, United States. Any disputes shall be resolved exclusively in the courts located in Boise, Idaho.
